TERMS AND CONDITIONS
InspireU Adventures requires that all clients contracting a service read, understand, agree and sign the following Terms and Conditions, cancellation policy and liabilities.
Booking a trip
Your booking is accepted and becomes definite only from the date when InspireU Adventures sends a confirmation invoice or email and always after the client has signed and agreed to the Terms and Conditions (this document) and send it to InspireU Adventures. Before your booking is confirmed and a contract comes in force, InspireU Adventures reserves the right to increase or decrease the price of any service.
Payment Method:
Payments must be made by bank transfer to InspireU Adventures account except in cases where it has been agreed differently in writing and approved by InspireU Adventures.
Final Payment and acceptance of the booking details:
Please, email to InspireU Adventures the bank reference number or remittance slips. Sometimes bank forwards the money with a different name. Having reference number / remittance slips and sender details makes it easier for us to check.
Payment Method. Registration and reimbursements.
At the time of registration, InspireU Adventures may require an advance payment that in no case will exceed 40% of the total amount of the trip, issuing the corresponding receipt specifying the amount advanced by the consumer and the requested trip. The remaining amount must be paid in the periods or dates agreed upon at the time of the deposit, and always at least 30 days before the date of departure. If the total price of the trip is not paid under the aforementioned conditions, it will be understood that the consumer desists from the trip requested, subject to the conditions set forth in the following section. All reimbursements that are pertinent for any reason, will always be formalized through InspireU Adventures, not making any refund for services not used voluntarily by the consumer.
Withdrawal of the consumer. Cancellations of the trip.
At all times the user or consumer can withdraw from the services requested or contracted, having the right to the refund of the amounts that he / she has paid, whether it is the total price or the advance provided in the preceding section, but must compensate InspireU Adventures for the following concepts:
- 48.40 euros (VAT included) per person of management expenses, plus cancellation fees, if the latter had occurred.
- A penalty, consisting of 5% of the total trip if the cancellation occurs more than ten and less than fifteen days before the date of commencement of the trip; 15% between days three and ten, and 25% within 48 hours prior to departure.
If you do not show up at the scheduled time of departure, you will not be entitled to any refund of the amount paid, unless otherwise agreed by the parties. In the event that any of the services contracted and cancelled are subject to special economic conditions of hiring, such as air freight, special rates, etc …, cancellation costs for withdrawal will be established in accordance with the conditions agreed by both parts.
The consumer of the trip may assign his reservation to a third person, requesting it in writing 15 days before the start date of the trip, unless the parties agree a shorter term in the contract. The transferee will have to meet the same requirements as the transferor, generally required for the trip, and both will be jointly and severally liable to InspireU Adventures for the payment of the price of the trip and the additional expenses justified for the assignment. In cases in which InspireU Adventures conditions, and so expressly specifies, the viability of the travel offer to have a minimum number of participants and that number is not reached, the cancellation of the trip may occur, and the user will be entitled to reimbursement of the total of the price or amounts advanced, without being able to claim any amount for compensation, as long as Inspire U Adventures has notified you in writing with a minimum of 15 days prior to the scheduled date of departure.
The client is strongly recommended to take out cancellation insurance at the time of booking. Please note that refunds are not accepted if a trip is voluntarily left for any reason after the trip has begun. No refunds will be made for any lodging, transportation, excursions, meals or unused services.
Cancellation and modification of a service by InspireU Adventures
All reimbursements and compensation are strictly limited to money paid to InspireU Adventures and no liability is accepted for personal expenses incurred as a result of this reservation (personal expenses such as visas, vaccinations, flights, car parking or other fees, loss of profits or loss of enjoyment, etc.).
InspireU Adventures reserves the right to cancel a service unless its operation is guaranteed.
InspireU Adventures reserves the right to cancel a service, including guaranteed service, for reasons beyond its control (for example, due to natural disasters, cancellation of flights, consequences of strikes, industrial action, wars, riots, disease, quarantine, government intervention, weather conditions, or other adverse occurrences). In this case, InspireU Adventures will refund the price of the service only. The customer has the right to select an alternative service of the same value.
InspireU Adventures reserves the right to make changes to the service, such as airline change, flight schedules or itineraries.
The Organization reserves the right to interrupt the transportation of any passenger that causes discomfort or inconvenience to other hikers / travelers / customers or creates difficulties that hinder the proper functioning of a trip and accepts no responsibility for loss or damage of luggage or personal belongings or any consequential loss resulting from such actions.
The local guide of the trekking / tour of the Organization has absolute authority. He / She may make decisions that incur itinerary changes or other amendments during the walk or activity in order to protect the safety of the clients or satisfy a specific requirement. If a customer commits an illegal act during a trip with the Organization, or if in the opinion of the tour leader or the land operator the client’s behaviour is detrimental to the safety and well-being of the group as a whole, this client will be asked to leave the trek / route without any right or refund.
InspireU Adventures reserves the right to cancel a reservation if the balance is not paid before the required date, unless previously agreed in writing.
There will be no discounts or reimbursements for lost or unused services, this includes the voluntary / involuntary termination / departure of the trek / tour / activity or service, for example, due to illness, death of a family member, etc., late arrival to the tour, or premature voluntary or involuntary departure.
Medical conditions and special requirements
Participants must be in good health and have physical fitness commensurate with stated trip difficulty. It is the responsibility of the client to carry out a physical examination by a doctor to ensure that the client has adequate physical and health capabilities to make the trip he / she has contracted.
InspireU Adventures will do its best to meet Clients special requests including dietary, but such requests do not form part of the Contract and therefore the Company is not liable for not providing these requests.
Client’s Travel Insurance
It is compulsory that the participants are protected by an adequate and valid travel insurance that covers cancellation, accidents, injury, illness, health and death medical expenses, including any related to pre-existing medical conditions, emergency evacuation (including helicopter rescue and air ambulance), loss of items, theft of or damage to baggage, personal effects and personal liability.
It is mandatory that any insurance policy issued to cover emergency evacuation for trek does not exclude alpinism or mountaineering. Emergency evacuation and rescue must be covered up to the maximum elevation that the trek booked reaches.
Flight delays and Itinerary changes
Please, note that outdoor adventures are always unpredictable. Bad weather in mountain regions can cause domestic flights delays. InspireU Adventures shall not be held responsible for any delays or changes of itineraries caused by any domestic flight or helicopter delays.
In case of domestic flight delays prior to departure (flights from Kathmandu to the destination of the activity), InspireU Adventures will meet departing city accommodation (Guest House) and food (lunch and breakfast) costs prior to the trip. However, in case of delayed return domestic flights (flights from the destination of the activity to Kathmandu), the client is responsible to bear all additional expenses including food and accommodation costs.
If the client wishes to make an alternative arrangement such as Helicopter flight to avoid flight delays, all additional cost would be the client’s responsibility.
InspireU Adventures it is not responsible for any costs incurred as a result of missed international flight, but would assist to make alternative arrangements wherever possible.
During the trek or activity booked, InspireU Adventures or the guide leading the trip may have to make some changes to the itinerary due to unforeseen circumstances (for example, adverse weather conditions, terrain change due to landslides, customer safety, etc.)
Trip amendment
Booking amendments requested by the client will be treated individually and the Organization will try to satisfy the amendments if possible. Amendments can incur additional costs that the client will have to assume and pay as per indicated by the Organization.
Complaints
Any complaints with regards to trips run by the Organization should be immediately brought to the attention of the tour leader, ground operators or hotelier so that action necessary to rectify the matter can be taken.
For any complaint or claim, it must be sent in writing to hello@inspireuadventures.com. InspireU Adventures will do everything possible to resolve it as soon as possible.
If at the end of the trip a client feels that a valid complaint was not resolved, he must send a written notification to Inspire U Adventures within 14 days after the end of the service.
Documentation and responsibility
Clients are responsible for ensuring all necessary travel documents in order such as valid visa, valid and adequate travel insurance, international flight documentation, valid passport, etc.
The client is responsible for equipment that may be required on the selected service. The Organization is not responsible for failure to obtain the valid visa for any reason, or for any passports of documents left in its custody.
The Organization would not be liable for any injury / health conditions / emotional or other conditions suffered by the client during the trip. Similarly the services booked do not include any personal insurance. Therefore, the client is responsible for obtaining adequate insurance that covers the trek / tour / activity booked, including medical emergencies and evacuation by helicopter.
Updating of terms and conditions
InspireU Adventures reserves the right to update and amend these terms and conditions at anytime. It is the responsibility of the client to keep updated with any changes.
Acceptance of Terms and Conditions
On signing the booking form, clients accept the terms and conditions of this contract.
